(HELP) TVX Films situation (still not resolved)

Yeah, that's right. My image is being used for a pornographic movie called 'Body Magic'.
Did they have permission? Did they hell.
This happened a few months back (well, since I found out). Somebody noted me saying this company was using one of my pictures.. actually let me get this straight - a SELF PORTRAIT that I took at the age of FOURTEEN.
I don't know if you can see the descriptions too well but it is qouted as 'Hustlers Highest Rated' and a 'pleasure to watch'. The back of the cover was disgusting.
I looked it up on the internet and found out that was stocking it and a range of other dirty video websites that took pleasure in this.. what I ALSO found was that there was a note on the back
saying 'Everyone associated with this DVD is 18 or over'. 18 or over? yeah right.
I contacted hustler and they gave me the name of the company - TVX Films. After doing some good old fashioned research I found that the company makes new covers for the dvds and that the movie was actually pretty old!
As soon as I'd found out relevant information and I send a long and 'friendly' letter to TVX Films - to my suprise I got an abrupt e-mail back from the owner who claimed that 'his company does NOT steal pictures off the internet and he recieved it from a company they've been in business with for 25 years'.
I found it hilarious, since I still remember taking that photograph back in 2004, I even have one of the first prints at my local walmart store with the date on! AND my small watermark on the dress which had been removed on the dvd cover..
After a few e-mails I found it obvious that I wasn't getting anywhere and that the owner was definately a sleaze himself. This is what he said in reply to me, in big bold capital letters to make a statement -


He also claimed I was 'scheming' and had set him up - placing the image on a public domain so companies can steal it and I can sue them... er, what? I actually had this image on only one website for a few years until I joined flickr - just DeviantART and it was clear that wasn't a public domain when underneath each of my picture there is a disclaimer CLEARLY stating the obvious (that's it's copyright)... and ALSO i had a bloody © symbol and my name written across my dress!!! Isn't that enough to warn anyone off anyway?
When I asked for compensation he said "AS FOR COMPSENSATION;YOUR SILLY!". and this was one of the end comments he made -


My so called ten seconds of fame was from a porno dvd? No thanks.

I've contacted about three solictors near to where I live - they all say they cannot do anything because the company is based in Texas, USA. I've tried contacting lawyers over in America but not a lot of them will reply, a few lawyers that have told me I need at least £50,000 to take it on. I've even tried contacting the news but absolutely no reply from them either.
I feel like Im wasting my time, my image hasn't been removed, they sent me another cover claiming they'd removed it in the end.. I researched in on the net and they'd just shown me the cover that was originally on in the 80s.

REMOVED? I don't think so. Look, here's where it is STILL featured and this is from a quick web search -

Please could someone help me with this? It feels like I'm pulling at loose strings and that I have no power over people like this. I'm still only 17 and trying to make my way in photography. I feel like I cannot display this picture anymore in case someone knows it from the movie.. or even the fact that someone THINKS im in the movie and it gives me a bad name..

Please repost this, on news sites, blogs. ANYTHING. I'd really like some help with this case. I'd appreciate ANY advice you guys could give to me. Thank you very much for reading.

I say sue them but also pull in all the money you can from any other sites posting that video. Hit the lesser known sites with a complaint mainly a warning via email but "do not include other sites you had previously said this to" then file them in either a massive multi-law-suit for sexual harassment, slander, violation, of a minor verbal slander, anything that meets those terms of law breaking even blackmail, child abuse fit those terms. Be sadistic and make them paupers you have those rights and the terms. Be sure to request access the checks under a different name & bank and   then change your legal name (safety reasons) so you live and pull in the benefits break them spiritually mentally and physically in short Terrify them by that box image for them there is no escape in the land of broken thieves

Still not resolved? You know you could file a lawsuit against TVX Films. Do it. Sue them until they're broke.

case was just resolved last October for 82 thousand pounds. Took her 3 years, but it was definitely worth it.

I am a professional Photographer in Los Angeles. I feel bad for your situation. Your best bet is to take it to a corporate lawyer that deals with copyright infringement (since you are the original owner of the image). You will win the case if you can prove the image is yours andyou still have the original metadata of the file saying that is yours. Good luck with everything. I am sorry for your ordeal.

Your face is not to see in that picture! And it's a porn from the 80s, I don't think that it is popular. 50 year old fat man perhaps watched it, and I don't think that they know who is on the cover.

The fact of the matter is:

*The image is copyrighted and used without permission.
*Lara was 14 at the time the picture was taken.
*The company said they would not publish any more of the cover and they still are.
*You CAN see Laras face in the picture.
*Lara is probably writing this blog to ask for help, because her efforts so far have been unanswered.

Would YOU want to be on the cover of a porno?
No, because you are too hideously ugly like a horseface to appear on the cover of anything.

wow , i really hope this works out properly..
i rather suggest a blanket flamage on the net with your original and their copy - hosted (at a higher bandwidth providing host) email ABC television, NBC , FOX , and MPAA (Movie Picture Assoc. of America ) though they do have .. some questionable things to answer for in their copyright regime
-- get the name of the company they used ,..
find local television news station in texas (not hard with (usa) and email them ...

I seriously hope you win the case. It's rather disgusting that companies think they can walk all over artists online. It's even worse that this was a picture of you as a fourteen year old? For crying out loud, if I was that company, I'd have every movie destroyed. Good riddance :hug:

That's really disturbing!! It's really disgusting that these people indulge themselves to steal pictures and use it without permission... I've already read a magazine( a Hungarian one) recently in which a girl told her story which is exactly the same as yours. She uploaded a picture to deviantart which was considered to be too sexy...then someone told her that in a random blog, this picture can be found as the cover of a porn DVD...after that,she started to negotiate with a lawyer but he was helpless as the company who net this DVD is in the US and the co. claimed that as the picture was on the Internet, it was available for they can't do anything just wait until something happens...

This is the sickest thing I've ever heard....I hope your case will be solved. However, you are a great photographer and lots of people know that and I hope that this thing won't stop you doing more fabulous pictures. best wishes!

TVXFilms has no morals (or business sense). Not that I expect much in the way of morals from a porn company, but you get the idea. :D What they did to you is pretty low, but unfortunately you're not the only one that they have done this to.

They stole a photo from another DA member and put it on another DVD cover for a cheesy '70's era porno flick. There's more info about it in my latest journal entry. I got ahold of the photographer, and just as I suspected, he knew nothing about it.

I hope someone sues them into oblivion....

Did you talk to a lawyer? With you being 14 in the picture, you can have some serious money coming your way...
I am surprized that they even spoke to you like that. My advice is contact the local embasy in texas. Speak to some one there about the problem. This really has to be resolved. Not only where you a minor when the picture was taken, but you still are. The laws in the US protect minors. The company is promoting child pornography, really they are if the cover is 14 year old girl, and that is a very BIG no no here.

wow....that is such a shame. thats like, my biggest fear--i havent posted anything, i just signed up--but reading this makes me a little nervous. so how exactly do you watermark photos?? that would be horrible to have someone else not only steal a photo, but to take credit for it....that sucks. well, i hope that you can resolve it...

It's just really vile, the replies he sent back to you, both insulting and rude. The last damn thing you need. Your photo-art in front of a DVD Cover with a CD filled with whores and skanks.
Sleezy fatass. He'll die from a car crash. I hope...

Anyways, I've e-mailed a few good friends about it.
They're well on they're way to spread the news around, since it hasn't jolly well hit this town yet.

I just wanted to say I am awfully sorry that something this horrible and disgusting had to happen to you. I hope at some point in time they get what they deserve. Unfortunately, while the internet is international, laws and copyrights normally are not (which is something that needs to change due to the internet, and the sharing of ideas and art internationally on such sites as this).

Again, I am extremely sorry this has happened to you. I could only really imagine how you must feel.

Have you tried this from a civil law point of view vs. a criminal one?

My question is, if they like your picture so much and since it was a self-portrait which you took, why not see if they hire you as their personal photographer for the covers of their DVDs.

They obviously liked your talent, so use that to your advantage. I think I'm a bit late to reply to all this, but I think this is what you should do/should have done. It's a starting point.

Also, there's always money in sex. The image they used as well was not provocative, it was just a nice clean image, so why can't you do that kind of photography for them? Just a thought.

it may be a catalyst for other people beginning to claim for their images being used without consent as well. i'm just sorry your image was used for such a degrading purpose.

Publicity is like oxygen - needed to fan the flames. Put the fire out. Let it be, as the song goes. One thing, for certain, is that it will give some of these odious thieves even MORE incentive to lift images - cant you just see Monsieur Slimy at TVX & Co rubbing his chubby fingers in glee..........From an older perspective, with a daughter your age, one can only say beware, there's a world out there beyond imagining and the Web is but one window to its deepest shadows. Honour is forfeit in this day and age - never let your own be at risk.
